  • How long do I have to make a claim for personal injuries?

    There is a certain time limit within which you must file your personal injury lawsuit. Otherwise, you will be barred forever from filing such a lawsuit.  This time limit is called the "statute of limitations". In Massachusetts, you have three years from the date of the accident to file your personal injury lawsuit.  Time is of the essence.   • How long will it take to settle my Personal Injury claim?

    The time it takes to settle a claim depends on many circumstances. You must let your injuries heal and reach a maximum medical improvement before beginning settlement negotiations. If you settle your claim too early, you may miss out on compensation for future medical treatment, scarring, or rehab difficulties. Once the treating physician issues a final medical report stating the diagnoses of the injuries and their opinion as to the prognosis, the evaluation of the case for settlement can begin. At that time, we will submit all the medical records and bills along with a demand for compensation to the insurance company.  Insurance companies typically take between 30 and 60 days to evaluate the demand and begin negotiate a settlement.  More complex cases, however, may take longer.  It all depends on the issues of each case.

  • How much is my Personal Injury case worth?

    This is a very tough questions to answer without knowing all the facts and damages of an accident case.  All accident cases are different. There are many factors that are involved in determining the value of a case. These would include: the amount of your medical bills and expenses, the severity of your injuries; the length of time of your total and/or partial disability; whether or not there is permanency of injuries; scarring; broken bones; expected future medical expenses.  Our goal, however, is to put as much money into your pocket to fairy compensate you for your injuries. The amount of money you receive will depend on the factors listed above.

  • What if the person who caused the accident didn’t have enough insurance?

    If the negligent driver that caused your injuries had insurance, but not enough to fully compensate you for your injuries, you can file a claim for further compensation against your own insurance company, provided you have “underinsured coverage”.  This portion of your auto insurance policy is optional (unlike uninsured coverage, which is mandatory).  So, you should check with your insurance agent to make sure you have enough underinsured coverage.  That way, if you are ever seriously injured by someone who has the minimum insurance coverage required by law (currently $20,000.00 per person/$40,000.00 per accident), you will have enough underinsured coverage to fully compensate you for your injuries.  

  • Should I speak with the other person's insurance company after a car accident?

    The short answer is “NO”.  After a car accident the other driver’s insurance company will definitely be calling you.  They will seem really nice and try to get a recorded statement from you.  You must remember that the insurance adjusters are trained in taking statements from accident victims.  They will try and get you to slip up and say something that will hurt your injury claim.  They do this because they are looking out for the best interest of the insurance company and to protect their insured.  They will use your statements to argue that you were either entirely at fault for the accident or a percentage at fault.  This way they can either deny your claim entirely or reduce a possible settlement by the percentage of fault they assign you.  Before speaking with the other insurance company or agreeing to give a statement, any injury victim should consult with an experienced personal injury attorney.

  • What if the person who crashed into me has no insurance?

    If the person who caused the car accident that injured you has no insurance, you are still able to pursue a claim for your injuries.  Your own auto insurance policy has “uninsured coverage”.  The uninsured coverage portion of your insurance policy is mandatory for all Massachusetts automobile insurance policies.  So if you are injured by a negligent uninsured driver, you can file a claim for injuries against your own insurance company.

  • How do I pay for a personal injury attorney?

  • How will my medical bills get paid after a car accident?

    If you are injured in a car accident in Massachusetts, the Personal Injury Protection (PIP) benefits under your own auto insurance policy will pay the first $8,000.00 of your medical bills. If you have private health insurance, PIP will pay the first $2,000.00, and then the remaining medical bills will be submitted and paid by your health insurance. Once you have completed your treatment for your injuries or reached a maximum medical improvement for your injuries you will seek compensation for any medical bills over what PIP paid from the negligent driver’s insurance company.
