This is a very common question that we are asked when we first meet with people who have been injured in an accident in Massachusetts. In all honesty, it is very difficult to determine the value of your personal injury claim shortly after an accident. The value of a personal injury case is based on several different factors, and many of those are unknown or unascertainable soon after an accident.

For example, one important aspect is the total amount of the medical bills for treatment related to the injuries you suffered in an accident. Without knowing how much your medical bills are, it is very difficult to begin to estimate what your accident case may be worth.

Generally, it is only after you have completed your treatment or reached a maximum medical improvement that the approximate value of your injury case can be assessed.

The basic formula used to value an injury case focuses on three factors.

First: The total cost of your treatment or your medical bills,

Second: How much time you missed from work and income you’ve lost which would include income you may not be able to earn in the future because of the injuries you suffered in the accident.

Third: The pain and suffering you experienced from the accident and your injuries. This includes how the injuries affected and impacted your life.

While there are many other factors that must be considered in valuing a case these are the three that are often used in the basic estimation of the value of a case.

In most cases, it’s experience that allows an attorney to approximate what a case may be worth.  With the combined experience of nearly 50 years between Joe and I, we have developed a very unique approach to examining all factors and variables that may impact the value of a personal injury case. One thing’s for sure, though, you shouldn’t rely on the insurance company to tell you what your case is worth. In my experience, they will not pay you what they should unless they are forced to. That’s where we come in.
