Mahaney & Pappas, LLP obtained a $250,000 settlement for a woman who was injured in a trucking accident when she was hit and injured by an 18-wheeler on Interstate 93 in Boston, Massachusetts.

How the Accident Happened

On a nice weekend day in May of 2016 our client was driving her car on I-93 in the Dorchester area of Boston, MA. Her day started off normal until a tractor trailer came negligently speeding down the highway. Our client slowed down on I-93 for some light traffic.The truck driver was distracted and couldn't stop the 18-wheeler in time. The huge truck crashed into the rear of our client’s car totaling it and injuring our client.  

The Injuries Suffered in the Trucking Accident

She was treated at the scene by paramedics and transported via ambulance to Boston Medical Center’s Emergency Department. She suffered a head injury (a concussion), bruising to her left and right knees, back/neck pain and chest pain. She also sustained a large, curved shape laceration to her forehead, which required forty-five (45) stitches to close. 

Miraculously, she did not sustain any broken bones, but was extremely sore and in pain following the accident. She underwent 7 weeks of physical therapy for her upper back, neck, left leg, and right ankle. 

The Damages Sustained From This Accident

This client incurred approximately $15,000 in medical bills, which is really not very much considering the cost and expense of medical treatment these days. She also was out of work for a few weeks due to the injuries she suffered. While at first glance, this may not appear to be a very significant case, our office saw it much different.

The Impact of the Scar on Her Face

The most troubling injury from this accident was the facial laceration. Our client is an attractive and social woman, who is now left with a large scar on her forehead that is most likely to be permanent in nature. The scar is not linear, but jagged, almost spider like, and extends from above her left eye into her hairline.

While the value of a scar in a personal injury case is not easily determined, our office has extensive experience with scarring from accident cases. Initially, the trucking company’s insurance carrier did not see the scar as valuable as we did. We were, however, able to thoroughly negotiate and argue the impact of the scar on our client’s life and the emotional issues that the scar caused.

In the end, the insurance company conceded to our view of the case and value of the scar. They agreed to pay $250,000.00 to compensate our client for her injuries.
