Injuries That Resulted From the Middleboro Car Accident

The car accident involved an SUV that crashed into the driver side of a sedan.  The accident caused serious injuries to the female driver, male passenger, and infant. The female driver of the sedan, said to be in her early 20s, was in life-threatening condition due to multi-system trauma and was flown by medical helicopter to Rhode Island Hospital.  The injured male passenger was also transported to Rhode Island Hospital and the infant, believed to be less than a year old, was transported to Hasbro Children’s Hospital in Providence, Rhode Island.  The driver of the SUV suffered from non-life-threatening injuries generally described as chest injuries and was transported by ambulance to South Shore Hospital in Weymouth, MA.  The cause of the accident is currently unknown, but is reported to be under investigation by the Middleboro Police Department.

What to Consider When Investigating a Car Accident

As with all injury cases, when investigating a personal injury claim after a car crash, there are two main focuses to consider:  (1) Liability; and (2) Damages.

Liability can simply be defined as who is responsible for the accident and injury.  Usually, in a personal injury claim, liability hinges on the concept of negligence.  Negligence is the failure to execute reasonable care toward others.   When driving a motor vehicle, the operator has a duty to drive and control the car in a safe manner.  Therefore, if a driver breaches its duty to use safe caution, the driver can be legally considered negligent and liable for the injuries he or she caused.

The second focus, after liability is established, are damages.  Damages are the injuries a victim suffers and the amount of money he or she should be compensated for those injuries.  The amount to be compensated is then negotiated between the personal injury attorney for the injured party and insurance company.

If you have been injured in a car accident, it is recommended that you consult with an experienced personal injury attorney or firm.  This is especially so if you are involved in a car accident similar to the one described above.  If liability is not reasonably clear and the crash is under investigation, the injured person should take special precaution so they do not do or say anything that may hurt their claim.  Also, a personal injury attorney can help protect your rights, investigate your accident, and ensure you are fairly compensated for any injuries.
