We secured a $100,000.00 settlement for a young family man, who was rear-ended and seriously injured. There were two parts to this motor vehicle accident case. The first was pursuing a claim against the insurance company for the at-fault driver.  The second was pursuing an underinsured claim against our client’s own auto insurance company for additional compensation.

How the Accident Happened

On a fair day in December, our client was stopped on Route 9 in Framingham, MA. Another man was driving his car on Route 9 and failed to pay proper attention to the traffic. Due to his carless operation of his motor vehicle, he rear-ended our client. The collision was very serious and caused significant damage to the vehicles. More concerning, the car crash caused significant injuries to our client.

Summary of the Client’s Injuries and Damages

As a result of the accident, our client suffered back and neck injuries as well as a ruptured index finger FDP (Flexor Digitorum Profundus) tendon.  The injury to his flexor tendon in his finger required surgery. Additionally, he also underwent a conservative course of physical therapy to help him with his neck and back injuries.

This client incurred expensive medical bills and also missed time at work. These damages were factors that were used in determining the value of his case and negotiating a fair settlement.

How We Helped This Client

As we do with all accident cases, we provided this client with a complimentary case evaluation. At this initial meeting we reviewed the facts and circumstance of the case, explained the process of a personal injury claim from a car accident, and answered all of his questions.

This client was very happy and comfortable with our legal team and hired us to represent him. We accepted this case on a Contingent Fee basis and began our investigation into this case. First, we determined the amount of insurance coverage that the other at-fault driver carried. Unfortunately, that driver only had $25,000 in bodily injury coverage to others. Our investigation didn't stop there. We determined that our client was smart enough to purchase underinsured coverage. This is where experience in motor vehicle accienet cases is extremely important. An experienced personal injury attorney will know where else to look for addtional insurance coverage

We were able to obtain the $25,000 from the other driver’s insurance company and then pursued a claim for the underinsured motorist coverage from our client’s own insurance company. Although his insurance company refused to pay the full underinsured policy limits initially, our persistence and refusal to accept any less resulted in securing the full insurance limits for our client.
